Welcome to Getgeek ("Getgeek," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Getgeek Recruitment Platform ("Platform"), designed for recruiters to post jobs, manage candidates, and access AI-powered recruitment tools. By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

You affirm that:

• You are at least 18 years of age
• You are legally authorized to use the Platform in your jurisdiction
• If acting on behalf of an organization, you have the authority to bind that organization to these Terms
• Your use of the Platform complies with all applicable local, national, and international laws

2. Account Registration

2.1 Account Creation

Recruiters must create an account by providing accurate, complete, and current information, including:

• Personal information (name, email, professional details)
• Company information (company name, size, industry, location)

Purpose of Data Collection:

• To create and authenticate your user account
• To enable recruitment functionalities including job posting and candidate management
• To customize the Platform experience based on your company profile and hiring needs

Legal Basis: Data is collected under GDPR Article 6(1)(b) (necessary for contract performance).

2.2 Email Verification

Upon registration, we will send a secure verification link to your provided email address. This link:

• Is encrypted and transmitted via secure channels
• Authenticates your account and confirms email ownership
• Protects against unauthorized account creation

You must complete email verification to access full Platform features.

2.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

You may invite team members to collaborate under your organization's account with appropriate access controls.

3. Use of the Platform

3.1 Permitted Use

You agree to use the Platform solely for lawful recruitment purposes, including:

• Posting job openings and managing applications
• Evaluating and communicating with candidates
• Accessing AI-powered recruitment insights and analytics

3.2 Your Responsibilities

You are responsible for:

• The accuracy and legality of all resumes, job postings, and company data you upload
• Ensuring uploaded content does not violate third-party rights or applicable laws
• Compliance with employment laws and anti-discrimination regulations in your jurisdiction

3.3 Prohibited Conduct

You shall not:

• Misuse, interfere with, or disrupt the Platform's operations
• Use the Platform for fraudulent or unlawful purposes
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to Platform systems or other user accounts
• Scrape, data mine, or harvest data from the Platform without authorization
• Use the Platform to discriminate against candidates based on protected characteristics

4. LinkedIn Integration

4.1 LinkedIn SDK Usage

The Platform integrates with LinkedIn SDK to enable job posting functionality. By using this integration:

• You authorize Getgeek to connect your LinkedIn account for job posting purposes only
• Getgeek does not collect, access, or store your LinkedIn profile data, connections, messages, or other LinkedIn information
• Authentication is handled securely through LinkedIn's OAuth 2.0 protocol
• Job postings are transmitted directly to LinkedIn on your behalf

4.2 LinkedIn Data Privacy

Your LinkedIn credentials and data remain under LinkedIn's control

• LinkedIn's privacy policy governs their handling of your information
• You may revoke Getgeek's access to LinkedIn at any time through your LinkedIn account settings

4.3 No LinkedIn Data Retention

Important: Getgeek does not store or retain any data from your LinkedIn account. The integration is limited to facilitating job posts as directed by you.

5. AI-Powered Data Processing

5.1 AI Analysis of Platform Data

All data received by the Platform, whether uploaded by recruiters or submitted by candidates, is processed using artificial intelligence (AI) and machine learning technologies. This processing is necessary to:

• Analyze candidate resumes and qualifications
• Match candidates to job requirements
• Generate recruitment insights, reports, and predictive analytics
• Provide intelligent recommendations and automation features
• Deliver accurate, data-driven results to enhance your recruitment process

By using the Platform, you consent to AI-powered analysis of your recruitment data.

5.2 AI Model Training

Your data may be used to train, improve, and enhance our AI models. This includes:

• Training machine learning algorithms to improve matching accuracy and recommendations
• Developing new AI features and recruitment capabilities
• Enhancing natural language processing and data extraction
• Refining predictive models for candidate success

Data Protection: While used for AI training, your data is:

• Processed securely with industry-standard encryption
• Stored in accordance with our Privacy Policy
• Not sold, rented, or shared publicly
• Protected by contractual safeguards with AI service providers (e.g., OpenAI)
• Individual personally identifiable information is not exposed in AI model outputs.

6. Intellectual Property

6.1 Getgeek Ownership

All content, materials, software, designs, trademarks, and technology on the Platform are owned by Getgeek or its licensors and are protected by:

• Copyright laws
• Trademark laws
• Trade secret laws
• International intellectual property treaties

6.2 Limited License to Users

You receive a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Platform for recruitment purposes
• Use Platform features in accordance with these Terms

This license does not grant you any ownership rights or the right to sublicense, resell, or redistribute Platform content.

7. User Content and Data Rights

7.1 Your Data Ownership

You retain full ownership of all data, content, and materials you upload to the Platform, including:

• Job postings and company information
• Candidate resumes and applications
• Communication records and evaluation notes

7.2 License Grant to Getgeek

By uploading content to the Platform, you grant Getgeek a non-exclusive, royalty-free, worldwide, perpetual license to:

• Use, process, and store your data to provide and improve the Platform services
• Analyze data using AI and machine learning for recruitment insights
• Train AI models to enhance Platform functionality and accuracy
• Display your content within the Platform and to authorized users

7.3 Anonymized Data Usage for Marketing

Additionally, you grant Getgeek the right to:

• Reference anonymized performance outcomes and success metrics from your use of the Platform
• Create case studies or testimonials using aggregated, non-identifiable data
• Use de-identified examples for marketing, promotional activities, or client referencing

Privacy Protection: No confidential or personally identifiable information will be disclosed without your explicit consent. All references will be anonymized and aggregated to protect privacy.

7.4 Data Security Commitment

Your data will never be:

• Sold or rented to third parties
• Made publicly available without authorization
• Shared outside the scope of providing Platform services (except as required by law)

8. Third-Party Services and Sub-Processing

8.1 Third-Party Integrations

The Platform integrates with third-party services to deliver its functionality, including:

• OpenAI: For AI-powered analysis and natural language processing
• Amazon Web Services (AWS): For cloud infrastructure and data storage
• Google Cloud Platform (GCP): For cloud services and analytics
• LinkedIn SDK: For job posting integration

8.2 Getgeek as Data Sub-Processor

When engaging third-party service providers, Getgeek acts as a data sub-processor in accordance with GDPR Article 28. This means:

• Getgeek ensures all sub-processors are contractually bound to protect your data
• Sub-processors process data only on our documented instructions
• Data processing agreements meet GDPR compliance requirements
• Appropriate technical and organizational security measures are in place

8.3 Third-Party Responsibility

We are not responsible for:

• The availability, functionality, or security of third-party services
• Third-party privacy policies or terms of service
• Data breaches or issues originating from third-party systems

Your use of integrated third-party services is subject to their respective terms and policies. We encourage you to review them.

9. Data Security

9.1 Security Measures

Your data is protected through:

• Encryption at rest: AES-256 or equivalent standards
• Encryption in transit: TLS 1.2+ protocols
• Multi-factor authentication options
• Role-based access controls for team accounts
• Regular security audits and vulnerability assessments

10. Data Retention and Deletion

10.1 Data Retention Policy

We retain your data as long as:

• Your account remains active
• It is necessary to provide Platform services
• Required by legal obligations or for dispute resolution
• Needed for AI model training and service improvement

10.2 Account Deletion Requests

You may request deletion of your account and associated data at any time. However:

Important Notice: Per GDPR Article 17(3), when you request deletion:

• Your data will not be immediately deleted from our systems
• Data may be securely archived and retained where necessary for:

• Compliance with legal obligations (GDPR Article 17(3)(b))
• Establishment, exercise, or defense of legal claims (GDPR Article 17(3)(e))
• Scientific or historical research purposes (GDPR Article 17(3)(d))

• Retained data remains secure and protected with appropriate safeguards

• Jobs data
• Candidate data and applications

12. Termination

12.2 Termination by Getgeek

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

• You violate these Terms or applicable laws
• Your conduct poses a security or legal risk
• Your account remains inactive for an extended period
• You engage in fraudulent or abusive behavior

12.3 Effect of Termination

Upon termination:

• Your license to use the Platform ends immediately
• You remain liable for any outstanding payments
• Provisions regarding data retention, intellectual property, and liability survive termination

13. Indemnification

You agree to indemnify, defend, and hold harmless Getgeek, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Platform
• Violation of these Terms or applicable laws
• Infringement of third-party rights
• Content you upload or actions you take on the Platform

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Getgeek regarding the Platform.

14.2 Amendments

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Platform after changes constitutes acceptance.

14.3 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

14.4 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.5 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
